You found the house, signed the contract, completed the inspection, and started working with your lender. Then someone asks a question that may catch you off guard:

Who is your closing attorney?

For buyers who are new to South Carolina, especially those coming from states where title companies or escrow companies handle most closings, that can seem unusual. If the buyer and seller already agreed on the deal, why does an attorney need to be involved?

The answer is that a real estate closing is not just the meeting where everyone signs documents. By the time you sit down at the closing table, a substantial amount of legal and financial work has already taken place.

What Happens Before Closing Day

One of the most important parts of the attorney’s work is reviewing title to the property.

At its core, the question is straightforward: Can the seller transfer the ownership interest the buyer expects to receive?

Answering that question requires a review of the public records. Mortgages, liens, judgments, easements, restrictions, prior transfers, and other matters that can affect title. Most buyers never see the details of that work, but it is an important part of making sure problems are identified before they follow the buyer into ownership.

If the seller still owes money on the property, that also has to be addressed. Existing mortgages and other liens may need to be paid from the closing proceeds and properly released. That process is part of making sure the buyer receives the title contemplated by the transaction.

The closing attorney also prepares and reviews the legal documents involved in the sale. The deed transfers the seller’s interest in the property to the buyer. If the purchase is financed, the buyer will also sign loan documents that give the lender rights in the property.

Those documents matter long after closing day. They affect ownership, financing, and legal rights, so they have to be prepared, signed, and recorded correctly.

The Closing Is Also About the Money

A real estate closing involves more than title and paperwork. It also involves a large amount of money moving between several parties.

Funds may come from the buyer, the lender, or both. Those funds may then be used to pay off the seller’s mortgage, cover taxes and other adjustments, pay closing expenses, and ultimately provide the seller with the net proceeds from the sale.

That is why the closing statement is so important. It shows where the money is coming from and where it is going.

By the time the buyer sits down to sign, those figures should already have been reviewed and reconciled. A smooth closing is often the result of a great deal of work that the buyer never sees.

The Attorney Is There for More Than the Signing

In South Carolina, the attorney’s role is not simply to witness signatures.

The attorney is involved in the legal parts of the transaction and helps make sure the closing is handled properly from beginning to end.

That is why choosing a closing attorney should not be treated as a minor administrative detail. Good communication matters. So does identifying problems early, keeping the parties informed, and making sure the transaction continues moving toward closing.

For the buyer, that often means asking questions before closing day rather than waiting until something becomes a problem.

What Buyers Can Do to Make Closing Easier

You do not need to understand every part of real estate law to have a smooth closing.

You do need to stay involved.

Make sure the closing office has your correct contact information. Respond when documents or information are requested. Review the information you receive from your lender and closing attorney. Ask questions when something does not make sense.

And before sending money, always verify wiring instructions directly with the closing office.

Real estate wire fraud is a serious risk, and fraudulent instructions can look convincing. If an email suddenly changes the wiring information or asks you to send money somewhere different, do not rely on the email alone. Confirm the instructions using contact information you already know is correct.

A short phone call can prevent a very large problem.

Closing Day Should Feel Simple

From the buyer’s perspective, closing day may feel almost anticlimactic.

You arrive, review the documents, sign your name several times, and eventually get the keys.

But that simplicity is only possible because the work has already been done.

The title has been reviewed. Existing mortgages and liens have been addressed. The documents have been prepared. The money has been accounted for. The transaction has been coordinated with the lender, seller, agents, and other parties involved.

When all of those pieces come together, the closing itself should feel straightforward.

That is exactly how it should feel.
